By accessing or using YardMind ("the App"), operated by YardMind Technologies LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. By using YardMind, you also agree to be bound by Google's Terms of Service where applicable.
YardMind is an AI-powered garden care application designed for personal, non-commercial use. You must be at least 13 years of age to use this App. You agree to use the App only for lawful purposes and in accordance with these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at hello@yardmind.net.
YardMind offers a free tier and a paid Pro subscription at $29.99 per year. Subscriptions automatically renew annually unless cancelled. You may cancel your subscription at any time by contacting us at hello@yardmind.net or through your app store account settings.
All payments are processed through Google Play or the Apple App Store. Refunds are subject to the respective store's refund policy.
YardMind uses artificial intelligence (powered by Anthropic Claude) to provide plant identification, health analysis, and care recommendations. AI-generated content is provided for informational purposes only and should not be relied upon as professional horticultural or agricultural advice. We make no warranties regarding the accuracy of AI-generated content.
By uploading photos or other content to YardMind, you grant us a non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing the App's services to you. You retain all ownership rights to your content.
Weather data is provided by OpenWeatherMap. We do not guarantee the accuracy of weather data and are not responsible for any decisions made based on weather information provided by the App.
The App and its original content, features, and functionality are owned by YardMind Technologies LLC and are protected by US and international intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our App without our express written permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YARDMIND TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Any disputes arising from these Terms or your use of the App shall first be subject to informal negotiations for 30 days. If unresolved, disputes shall be settled by binding arbitration in Harris County, Texas, in accordance with the rules of the American Arbitration Association. You have 2 years from the date a cause of action arises to bring a claim against us.
These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in Harris County, Texas.
We reserve the right to modify these Terms at any time. We will notify you of significant changes by email to the address associated with your account. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
